Watch Out for GDPR-Like State Data Breach Laws of 2018

Not long ago we viewed the regulatory requirement to report a personal data breach within 72 hours as a provision that only existed in Europe’s recently enforced General Data Protection Regulation (GDPR) which gives control back to consumers regarding their personal information held by businesses. State regulations in the U.S. are adopting the “72-hour notification” requirement or very similar provisions in response to recent data breaches. Most state laws have increased penalties for data breach notification violations and have amended consumer privacy rights and data breach requirements to mimic GDPR.
